Thank you for booking and/or traveling with Adventure People, a subsidiary of Expedition Ventures Group, Inc.
These Terms and Conditions apply to any travel products and/or services purchased from Adventure People and govern the contractual relationship between you and Adventure People with respect to any such travel products and/or services (hereinafter, the “Products”).
Please read these Terms carefully as by booking any Product with Adventure People, or by traveling on an Adventure People tour or Product, you acknowledge that you: i) have read and understand these Terms, and ii) indicated your express acceptance of and agree to be bound by these Terms, if you have confirmed a booking on any Products with more than one client named and booked on such booking, you shall be deemed to have accepted these Terms and Conditions (the “Terms”) on behalf of all clients named in the booking (including minors and those under a disability) and traveling on or otherwise participating in any Products (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicated their assent to these Terms. The Client who confirmed the booking is deemed to be the designated contact person for all other clients named in such booking.
These Terms & Conditions are subject to change at any time with or without notice. Your agreement to these Terms & Conditions constitutes your agreement to any updates which can be found here.
The Booking Contract
A booking is confirmed and these Terms shall apply when Adventure People, or an authorized agent acting on Adventure People’s behalf, have received the applicable deposit from the Client and the Client has received written confirmation from Adventure People of such booking. Any Client confirming a booking on any Products with more than one Client named and booked on such booking represents and warrants to Adventure People that: i) they have all requisite consents and authority to make such a booking on behalf of all other Clients named on the booking, and have communicated all necessary information to the other Clients in order for them to give free and fully informed authorization to do so; ii) the information that they are providing regarding all clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with Adventure People for the purposes of completing the booking; and iii) they will inform all other named Clients on the relevant booking of the applicability of these Terms to the booking and the Clients’ relationship with Adventure People.
Medical Conditions & Medical Form
Adventure People brings together people of all ages on our Product tours. Client understands that, as a minimum, an average level of fitness and mobility is required to undertake any of our Product tours. Travelers must be able to walk without the aid of another person, be able to climb 3-4 flights of stairs, step on and off small boats, and carry their own luggage, at a minimum. You must inform us at the time of booking if anyone in your party has a disability, medical or behavioral condition which could affect their participation in the trip or other people on the trip.
All Clients are obligated to provide requested relevant medical information to Adventure People upon booking their tour Product and must return a Medical Information Form, duly signed by a licensed, competent and practicing physician, as indicated, to Adventure People prior to or in conjunction with that Client’s final payment in respect of the applicable booking if Client indicates any pre-existing medical conditions which may have impact on the Client’s ability to complete activities included in the tour Product, the Client’s ability to travel to remote areas removed from medical facilities, or which may have any impact whatsoever on the Client’s ability to travel or the travel experience of others on the Product tour;
The Client agrees to complete the medical form honestly, accurately and represents and warrants to Adventure People that they will disclose all relevant medical information accurately and fully. Adventure People will maintain the information in strict confidence, in accordance with the Adventure People Privacy Policy. Adventure People reserves the right to deny any Client permission to travel or participate in a Product where Adventure People, acting reasonably, deems necessary with regard to the health and safety of the booking Client, any other Clients traveling with Adventure People, or Adventure People staff or representatives, and may use information provided in the Medical Form, expert opinions, and other information in formulating such decision. Adventure People will provide a written explanation for any such decision upon request from the Client. In the event the Client has made a booking with Adventure People and subsequently is unable to complete the required medical form for any reason by the deadline indicated above, Adventure People reserves the right to treat such Client’s booking as canceled, and all applicable cancellation fees shall apply.
Clients are responsible for assessing their own suitability and capability to participate in the tour Product such Client has booked. All Clients should consult their physician regarding their fitness for travel, and adventure travel in particular. Adventure People encourages all Clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of the Client’s travel with Adventure People. Adventure People does not provide medical advice. Certain Products may not be suitable for all people due to restrictions posed by limitation in mobility, physical or cognitive disability, pregnancy or various other physical or mental conditions. It is the Client’s responsibility to assess the risks and requirements of each Product in light of such Client’s limitations, physical and mental fitness condition, and any medical requirements or issues of such Client. Adventure People may refuse to carry pregnant women over 24 weeks or Clients with certain conditions if suitable accommodation or alternate Products or services cannot be arranged.
Adventure travel, as offered by Adventure People, by its nature involves visiting remote or less developed regions, where medical facilities may not meet the standards of those found in a Client’s home country. The condition of medical facilities in the countries in which Adventure People operates varies and Adventure People makes no representations and gives no warranties in relation to the standard of such facilities or medical treatment in those regions.
Insurance
CLIENT ACKNOWLEDGES THAT IT IS MANDATORY THAT THEY OBTAIN TRAVEL INSURANCE WITH A MINIMUM MEDICAL EVACUATION AND REPATRIATION COVERAGE OF $200,000 covering all applicable dates of any travel with Adventure People and this insurance must cover personal injury and emergency medical expenses. Client acknowledges that they will not be allowed to join the tour if they are not able to provide proof of insurance.
It is strongly recommended and encouraged that Clients also extend their coverage to include cancellation, curtailment, and all other expenses that might arise as a result of the loss, damage, injury, delay or inconvenience occurring to the Client. The Client acknowledges that the cost of the tour Product does not include any insurance coverage for such Client and that the Client is required to obtain separate coverage at an additional cost to the Product tour price. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken so that the insurer may properly cover travel on the applicable Adventure People Product.
Pricing
Due to the nature of Adventure travel and the prices of the resources on which it depends, the published price of any Product is subject to change at any time, before booking confirmation, up to 30 days before departure of such Product. Tours are priced and advertised inclusive of applicable sales taxes. Rates can only be guaranteed after a deposit has been paid by the client and a confirmation has been issued by Adventure People to the Client. Prices are per person, based on double occupancy. Advertised air-inclusive tour prices are based on the lowest-priced seating, travel season, and gateway. All prices are in U.S. dollars. Adventure People cannot be held responsible for fluctuations in exchange rates when calculating refunds due to trip cancellations.
From time-to-time Adventure People may offer reduced pricing on selected tour Products. The reduced pricing applies strictly to new bookings. Bookings that have already been confirmed are not entitled to the reduced pricing.
Deposits
To reserve a spot on any of our tour Products, a deposit is required upon sign up. The deposit is NON-REFUNDABLE. The Client confirming the booking must be no less than 18 years of age and agrees to provide full, complete, and accurate information as requested by Adventure People to confirm such booking. Failure to provide this information at the time of booking could result in additional fees.
Once we receive your deposit, we will send you a confirmation email of your booking. Once the Product has been confirmed (met its minimum number, which is typically 6 travelers), you’ll receive an electronic packet with detailed trip information and suggested flights. PLEASE DO NOT PURCHASE AIRFARE UNTIL YOU HAVE RECEIVED A CONFIRMATION EMAIL.
If we do not meet the minimum number of travelers by the final payment date, which is typically 90 days prior to departure, we will refund your money or you may apply it to another Product.
Final Payment & Acceptance of Booking
Clients should refer to the confirmation sent by Adventure People and/or its authorized agent and/or their applicable confirmation email for details regarding the final payment for any Products booked. Payment of the balance of the price for any Product is typically due 90 days prior to the departure date of the Product. If payment is not received by such due date, Adventure People reserves the right to treat the Product as canceled and shall retain the deposit paid on booking as a cancellation fee. If a Product is booked less than 90 days before the departure date, then the full amount is payable at the time of booking in order for the booking to be confirmed. If for any Product, payment terms differ from those outlined in this section, the applicable terms will be communicated to the Client prior to booking and shall also be detailed on the applicable invoice.
Adventure People is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of Products and will not refund or return any fees charged by such third parties in connection with payments made by Clients to Adventure People.
Cancellation of Tour Product by the Client
All cancellations must be advised in writing. We calculate your refund on the day we received written notice of cancellation. The applicable cancellation fees shall be determined with reference to the date on which the request to cancel is received by Adventure People. All refunds will be processed within a few days of your cancellation. Cancellation of a tour Product or failure to join a tour Product will result in retention of funds by Adventure People, as follows:
91+ days prior to departure: Full deposit shall be held by Adventure People90 to 61 days prior to departure: Full deposit and 50% of the total trip price shall be held by Adventure People60 days prior to departure: Full deposit and 100% of the total trip price shall be held by Adventure People
Cancellation of Arrival Transfers, Pre and/or Post Trip Accommodations and Single Supplements by the Client
31+ days prior to departure: Clients shall receive a full refund for Arrival Transfers, Pre and/or Post Trip accommodations, and Single Supplements.30 to 0 days prior to departure: Clients shall receive NO refund for Arrival Transfers, Pre and/or Post Trip accommodations, and Single Supplements.
Cancellation of a Tour Product by Adventure People
Adventure People and its agents reserve the right to cancel a tour Product for any of the following reasons:
(a) We do not meet the minimum number of travelers by the final payment date, which is typically 90 days prior to departure for international departures and 60 days prior to departure for domestic departures.
(b) For reasons of Force Majeure due to acts of nature
If a tour is canceled by Adventure People before the agreed date of departure for the reasons stated above, the Client shall have the choice of:
(a) accepting from Adventure People a substitute tour Product of lower or equivalent value, where such substitute is reasonably available; or
(b) accepting from Adventure People a full refund of all monies paid for the canceled tour Product(s).
Adventure People is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the canceled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.
Single Supplements
Clients who are traveling alone are never required to pay a “single supplement.” Adventure People offers roommate matching to pair you with a same-sex roommate. Should there be an odd number of men to women, you may be asked to join a triple occupancy room. However, you may optionally reserve a single room for yourself, if you choose not to share with someone else. Please see the detailed itinerary for each Product as the amount involved varies.
Travel Documents
The Client is entirely responsible for securing, and must be in possession at all times, a valid ID or passport required for travel to each country or regions visited throughout the itinerary of the applicable tour Product, and for re-entry to the Client’s country of residence or departure. Passport must be valid for 6 months past the last date of travel with Adventure People.
The client is also responsible for securing visas, permits, and certificates including vaccination certificates, and insurance policies required for entry into all regions and participation in all parts of the Product tour itinerary. The Client accepts full responsibility for obtaining all such documents, visas, and permits prior to the start of the Product tour, and is solely responsible for any adverse consequences resulting from missing or defective documentation. The client agrees that they are responsible for the full amount of any loss or expense suffered or paid by Adventure People which are a direct result of the Client’s failure to secure proper travel documentation. It is the Client’s full responsibility to have the correct travel documentation.
Flight Delays & Cancellations
Adventure People cannot be held responsible for any flight delays or cancellations caused by reasons including but not limited to weather, mechanical issues, or personnel strike. In the event of a flight delay, the Client must work directly with the airline to be re-booked. Once a new flight is confirmed, they must notify the Trip Leader with their new arrival time. If the Client is arriving later than the start date of the Product tour, the Client understands that they may need to arrange transportation at their own expense to catch up with the group. Persons missing tour portions or components (including, but not limited to, meals, excursions, or sightseeing tours) due to flight delays or cancellations will not be refunded by Adventure People and will also not be eligible for a change of return date.
Flexibility, Changes & Unused Services
The Client acknowledges that by booking a Product and/or agreeing to travel with Adventure People that the nature of adventure travel requires considerable flexibility and acknowledges that they will permit reasonable alterations to the Product and/or itinerary by Adventure People. The Client acknowledges their understanding that the route, schedules, itineraries, amenities, and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the Product will be operated, flight cancellation, strikes, events emanating from political disputes, entry or border difficulties, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Adventure People and that Adventure People is not liable to any Client for such changes or amendments.
Safety and Security
We recommend that you check your government’s advice for the latest travel information before departure. Our guides will accompany us on all included activities. During our trip, you will have some free time to pursue your own interests. While our guides will assist with options available in a given location, please note that any optional activities you undertake that are not part of the itinerary, are at your own risk. We offer no representations about the safety of the activity or the standard of the operators running them. While most of the cities we will visit are generally safe, there can be risks when wandering through a major city at night and it is our recommendation that you stay in small groups and take taxis to and from restaurants or other nighttime excursions. We also advise staying away from any protests and demonstrations. Even those that are well intended have the potential to turn violent with no warning. Adventure activities and water-based activities have an element of danger and excitement built into them. We recommend only participating in activities when accompanied by a guide(s). We make every reasonable effort to ensure the fun and adventurous element of any of our planned activities, and we take all prudent measures in relation to your safety, but please use your own good judgment. Participating in adventurous activities is always at your own risk.
General Rules
Illegal drugs will not be tolerated on any trips. Possessing or using drugs not only contravenes the laws of the land but also puts the rest of the group at risk. Our philosophy of travel is one of respect towards everyone we encounter and in particular the local people who make the world the special place it is. The exploitation of prostitutes is completely contrary to this philosophy and therefore prohibited. The trip leader has the right to expel any member of the group if drugs are found in their possession or if they use prostitutes.
